Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Bevera Media Intelligence Platform (the “Platform”), a software-as-a-service (SaaS) tool providing business intelligence to professionals in the beverage industry. By signing up or using the Platform, you agree to be legally bound by these Terms. If you do not accept these Terms, you must not use the Platform.

1. Who We Are

Bevera Ltd. (“Bevera”, “we”, “our”, “us”) is the operator of the Bevera Media Intelligence Platform. We provide beverage businesses with access to market trends, competitor analysis, and strategic insights through a cloud-based subscription platform.

2. Eligibility and Access

To access the Platform, you must:

Be 18 years or older
Provide accurate, complete registration details
Be authorised to use the Platform on behalf of your organisation (if applicable)

We reserve the right to refuse or suspend access if we reasonably believe your use breaches these Terms or applicable laws.

3. Account and Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities conducted through your account
Promptly notifying us of any unauthorised use or security breach

You must not:

Share your login details with others
Use another user’s account
Attempt to circumvent access controls or security features

4. Permitted Use

You are granted a limited, non-exclusive, non-transferable licence to use the Platform for internal business purposes only. You agree not to:

Reverse engineer, duplicate, distribute, or create derivative works based on the Platform
Use automated tools (e.g. bots or scrapers) to extract Platform content
Use the Platform for unlawful or unauthorised purposes

All rights not expressly granted in these Terms are reserved by Bevera.

5. Intellectual Property

All data, reports, interface designs, software code, and documentation available through the Platform remain the intellectual property of Bevera or its licensors.

You may view, download, and use materials solely for business decision-making within your organisation. You may not resell, republish, or externally distribute Platform outputs without our prior written consent.

6. Data Input and Privacy

Any data you input into the Platform remains yours. By using the Platform, you grant Bevera a limited licence to process and store your data to deliver the services.

We handle your data in accordance with our [Privacy Policy] and applicable data protection laws (e.g., GDPR or PIPEDA, depending on jurisdiction).

7. Availability and Service Levels

We strive to maintain 99% uptime but do not guarantee uninterrupted access. Bevera is not liable for any temporary outages, interruptions, or data loss.

Platform performance may be affected by scheduled maintenance or unforeseen technical issues. We will provide reasonable notice of planned disruptions.

8. Termination

You may cancel your account at any time by contacting support or accessing your account settings. Bevera may suspend or terminate access if:

You breach these Terms
Payment (if applicable) fails and remains unresolved
The Platform is discontinued (with appropriate notice)

Upon termination, your access ends, and all associated data may be deleted after a retention period in line with our Privacy Policy.

9. Disclaimers and Limitation of Liability

The Platform is provided “as is” without warranty of any kind. While we strive for accuracy, Bevera does not guarantee that all insights or forecasts are error-free or suitable for your particular business decisions.

To the fullest extent permitted by law:

Bevera is not liable for indirect or consequential losses
Our liability for any claim is limited to the total amount paid by you for Platform access in the previous 12 months

10. Changes to These Terms

We may update these Terms from time to time. If we do, we will notify users via email or the Platform dashboard. Continued use after updates means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of “Canada, Province of Nova Scotia”, and any disputes shall be subject to the exclusive jurisdiction of the courts of that region.
